BNC Legal Expert: Judge Cahill was 'duty-bound' to reinstate third-degree murder charge


As the jury selection process continues in the Derek Chauvin trial, Hennepin County Judge Peter Cahill reinstated the third-degree murder charge. Chauvin initially faced the charge days after George Floyd’s death, but Cahill dismissed it in the fall, saying it did not apply to the case. BNC Legal Correspondent Candace Kelley joined Start Your Day with Sharon Reed and Mike Hill to discuss the move that is a win for the prosecution. Eric Nelson, Chauvin’s defense attorney, tried to keep the third-degree murder charge thrown out, but Cahill did additional research in reference to case precedent. “He had no choice but to be duty-bound,” said Kelley, citing that single acts directed at a single person now equate to a third-degree murder charge.
